Welcome to Pipit. These Terms of Service ("Terms") govern your access to and use of the Pipit website (pipitbirding.com) and the Pipit mobile application (together, the "Service"), operated by Pipit ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
You must be at least 13 years old to use Pipit. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or guardian. By using Pipit, you represent that you meet these requirements.
To use certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please provide accurate information and keep it up to date. Notify us promptly of any unauthorized use of your account.
You agree to use Pipit in a lawful and respectful way. You may not:
Pipit lets you submit content such as sighting logs, photos, audio, notes, and profile information ("Your Content"). You retain ownership of Your Content. By submitting it, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and share it as needed to operate and improve the Service (for example, showing your sightings in the community feed or on leaderboards, according to your privacy settings).
You are responsible for Your Content and represent that you have the rights to share it. We may remove content that violates these Terms.
Pipit may allow you to share sighting locations. Please be thoughtful about sharing precise locations of rare, threatened, or sensitive species, as this can put them at risk. You control your location-sharing settings, and you use these features at your own discretion and responsibility.
Pipit offers competitions, leaderboards, and games. These are for enjoyment and community engagement. We reserve the right to manage, adjust, or remove competitions and to disqualify participants who violate these Terms or compete dishonestly. Competitions carry no cash value unless explicitly stated.
Pipit is under active development. Features may change, break, or be removed, and the Service may be unavailable at times. We may modify or discontinue any part of the Service at any time without liability.
The Pipit name, logo, design, and software are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute them without our permission. These Terms do not grant you any rights to our branding.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that any information (including species identifications) is accurate. You use the Service at your own risk.
To the fullest extent permitted by law, Pipit and its founders will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us, if any, in the twelve months before the claim.
You may stop using Pipit at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Certain provisions (such as intellectual property, disclaimers, and limitation of liability) survive termination.
We may update these Terms from time to time. If we make material changes, we'll update the "last updated" date and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the revised Terms.
